Please review the following terms carefully. They govern your use of our website and services, and form part of any service agreement with Modern Construction USA Corp.
By accessing or using the website, services, or entering into any service agreement with Modern Construction USA Corp ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services or website.
These Terms constitute a legally binding agreement between you ("Client," "you," or "your") and Modern Construction USA Corp. We reserve the right to modify these Terms at any time, and your continued use of our services following any changes constitutes acceptance of the updated Terms.
Modern Construction USA Corp provides general construction, renovation, plumbing, electrical, interior design, exterior design, and related building services. The specific scope of work for each project is defined in a separate written estimate, proposal, or contract agreement between the Company and the Client.
All estimates and proposals provided by the Company are based on the information available at the time of assessment. Estimates are valid for 30 days unless otherwise stated. Actual project costs may vary based on unforeseen conditions, material price fluctuations, client-requested changes, or other factors. Any changes to the agreed scope will be documented through a written change order and may affect project cost and timeline.
We will perform all work in a professional and workmanlike manner, in compliance with applicable building codes, local regulations, and industry standards. We maintain all required licenses and insurance for the jurisdictions in which we operate.
Payment terms are outlined in your project agreement. Unless otherwise specified, our standard payment schedule consists of an initial deposit upon contract signing, progress payments at defined milestones, and a final payment upon project completion and client walkthrough approval.
Payments not received within 15 days of the invoice date may be subject to a late fee of 1.5% per month on the outstanding balance. The Company reserves the right to suspend work on any project with outstanding overdue payments until the account is brought current.
Deposits are generally non-refundable once work has commenced or materials have been ordered. In the event of project cancellation before work begins, the Company will refund the deposit minus any costs already incurred for planning, permitting, or material procurement.
Estimated project timelines are provided in good faith based on normal working conditions. The Company is not liable for delays caused by weather conditions, natural disasters, or other acts of God, material supply shortages or delivery delays beyond our control, changes in scope requested by the Client, permitting or inspection delays imposed by local authorities, or pre-existing structural issues discovered during construction.
In the event of anticipated delays, we will notify the Client promptly and provide a revised timeline. Delays caused by the above factors do not constitute a breach of contract.
We provide a one-year warranty on all workmanship from the date of project completion. This warranty covers defects in our labor and installation. It does not cover damage caused by client misuse, normal wear and tear, unauthorized modifications by third parties, or natural settling and movement of structures.
Materials used in your project may be covered by manufacturer warranties. These warranties are separate from our workmanship warranty and are subject to the terms and conditions set by the respective manufacturers. We will provide relevant manufacturer warranty documentation upon project completion.
To file a warranty claim, please contact us in writing within the warranty period with a detailed description of the issue. We will inspect the reported concern and, if covered under warranty, perform the necessary repairs at no additional cost.
To the maximum extent permitted by applicable law, Modern Construction USA Corp shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services, including but not limited to loss of profits, loss of use, business interruption, or damage to property not under our care, custody, or control.
Our total aggregate liability for any claim arising out of or related to these Terms or our services shall not exceed the total amount paid by the Client under the applicable project agreement. This limitation applies regardless of the theory of liability, whether based on contract, tort, negligence, strict liability, or otherwise.
The Client agrees to provide accurate and complete information regarding the project, to ensure safe and reasonable access to the project site during scheduled working hours, to obtain any necessary homeowner association or landlord approvals before work begins, to make timely decisions on material selections, design choices, and change orders to avoid project delays, to ensure the project site is free from hazards not related to the construction work, and to make payments according to the agreed schedule.
Failure to fulfill these responsibilities may result in project delays, additional costs, or suspension of work.
The Client may cancel the project at any time by providing written notice. Upon cancellation, the Client is responsible for payment of all work completed, materials ordered or delivered, and any cancellation fees as outlined in the project agreement.
The Company reserves the right to terminate or suspend services if the Client fails to make payments as agreed, the Client engages in conduct that creates an unsafe working environment, the project site conditions pose unacceptable risks to our workers, or continuing the project would violate any applicable law, code, or regulation.
In the event of a dispute arising from these Terms or any project agreement, both parties agree to first attempt to resolve the matter through good-faith negotiation. If negotiation is unsuccessful, the parties agree to participate in mediation before a mutually agreed-upon mediator.
If mediation fails to resolve the dispute, either party may pursue binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in New York, NY. The decision of the arbitrator shall be final and binding on both parties.
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
By using our website, you agree not to reproduce, duplicate, copy, sell, or exploit any portion of the website without our express written permission, to use the website only for lawful purposes and in accordance with these Terms, to refrain from attempting to gain unauthorized access to any part of the website or its connected systems, and to not introduce any viruses, malicious code, or harmful material to the website.
All content on our website, including text, graphics, logos, images, and software, is the property of Modern Construction USA Corp or its content suppliers and is protected by United States and international copyright laws.
